at https://circlebot.xyz (the "site", "website") and/or the Circle Discord Bot (the "Bot"), that are conjointly referred to as the
"Service", which is operated by Circle Bot ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and
others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the
Service.

These Terms of Service were last revised on Jan 24, 2024. We may change these Terms of Service at any time and for any reason. We encourage you to review these Terms each time you visit the website. If we make a significant change to our Terms of Service, we will post a notice on the homepage of our website for a period of time after the change is made. We reserve the right to change or modify these Terms at any time.
Access to the Service
We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. The suspension or deletion of your account(s) shall not entitle you to any claims for compensation, damages or reimbursement. The suspension or deletion of accounts due to causes attributable to you does not exempt you from paying any applicable fees or charges.
Collection of Data
By using the Service, we reserve the right to collect your basic Discord user information (Username, Avatar, Discord ID, Guilds you are a member of). You may revoke this access at any time through your Discord account settings. Our full privacy policy can be found here.
Limitation of Liability
Our team works hard to ensure that Circle is the best it can be. However, we make no guarantees that Circle will always be safe, secure, bug-free or function without disruptions. We may suspend, discontinue, or otherwise modify any part of the Service at any time with or without notice. Our liability is limited to the maximum extent permitted by law, and under no circumstance will we be liable to you for any lost profits, revenues, information, data, even if we have been advised of the possibility of such damages.

We hold and reserve all intellectual property rights for any such content displayed on the Service. Users may not therefore use such content in any way
that is not necessary or implicit in the proper use of the Service. In particular, but without limitation, users may not copy, download, share (beyond the
limits set forth below), modify, translate, transform, publish, transmit, sell, sublicense, edit, transfer/assign to third parties or create derivative
works from the content available on the Service, nor allow any third party to do so through the user or their device, even without the user's
knowledge.
Where explicitly stated on the website, the user may download, copy and/or share some content available through the website for its sole personal and
non-commercial use and provided that the copyright attributions and all the other attributions requested by the us are correctly implemented. Any
applicable statutory limitation or exception to copyright shall stay unaffected.
Access to External Resources
Throughout the service you may have access to external resources provided by third parties. You acknowledge and accept that the we have no control over
such resources and therefore not responsible for their content and availability. Conditions applicable to any resources provided by third parties,
including those applicable to any possible grant of rights in content, result from each such third parties' terms and conditions or, in the absence of
those, applicable statutory law.
In particular, on the website you may see advertisements provided by third parties. We do not control or moderate the advertisements displayed via the
website. If users click on any such advertisement, they will be interacting with any third party responsible for that advertisement.
Acceptable Use
The Service may only be used within the scope of what it is provided for, under these Terms and applicable law. Users are solely responsible for making sure that their use of of the Service violates no applicable law, regulations or third-party rights. Therefore, we reserve the right to take any appropriate measure to protect our legitimate interests including denying you access to the Service, terminating contracts, reporting any misconduct performed through the Service to the competent authorities - such as judicial or administrative authorities - whenever users are suspected to be in violation of any laws, regulations, third-party rights and/or these Terms.
Excessive Use of the Service
Using a resource of the Service excessively in relation to other users of the Service is not permitted - in such cases, we, at our sole discretion reserve the right to suspend the your account or limit the related activity until you reduce the excessive consumption;
API Usage Terms
Users may access their data relating to the Service via the Application Program Interface (API). Any use of the API, including use of the API through a third-party product/service that accesses the Service, is bound by these Terms and, in addition, by the following specific terms: you expressly understand and agrees that we bear no responsibility and shall not be held liable for any damages or losses resulting from your use of the API or their use of any third-party products/services that access data through the API.
Premium
By purchasing an optional premium subscription, you authorize Circle to charge your payment method on a monthly, annual, or one-time basis depending on
your chosen option. This charge includes the base premium charge, taxes and/or transaction fees, and any other charges associated with the premium
service. You can stop this recurring charge at any time by canceling your subscription.
Prices on the Service are displayed excluding any applicable fees or taxes.
We may offer discounts or provide special offers for the purchase of a premium subscription. Any such offer or discount shall always be subject to the
eligibility criteria and the terms and conditions set out in the corresponding section of the premium page. Offers and discounts are always granted at the
our sole discretion. Repeated or recurring offers or discounts create no claim/title or right that you may enforce in the future. Depending on the case,
discounts or offers shall be valid for a limited time only or while stocks last.
You may cancel your subscription at any time, and you will retain your premium benefits until the end of the billing term. If you cancel your subscription
before the end of the billing term, we are not required to issue any credit, refund, or exchange. Refunds, issuing credit, and exchanges are done at our
sole discretion and not required by any means.
The "lifetime" premium offering is available for the duration of the Service's existence, rather than the User's actual lifetime, referred to as the
'lifetime of the Service.' This offering applies exclusively to the user who initially purchased it and is non-transferable. Circle reserves the right to
suspend or terminate the lifetime subscription at any time for any reason. In the event that Circle terminates access to the service or if the service
ceases to exist, no refunds are required to be issued for the lifetime subscription.
Circle reserves the right to suspend your premium membership at any time, for any reason. If your membership is suspended or canceled by Circle, we are
not required to issue you a refund.
